Our Mission:
To eradicate workplace discrimination by fostering, promoting and enforcing Federal and State Antidiscrimination Laws through community outreach; assuring fair and equitable opportunities required for profitable employment.

The Office of Antidiscrimination (OAD) is a neutral third party that will assist an aggrieved employee through the Antidiscrimination Administrative Process.  Before filing directly in court, an aggrieved employee must participate in this process. OAD is not authorized to provide legal advice.

What is Discrimination?

You may be familiar with the word “discrimination” but do you know what it really means? And do you understand how it applies in the context of your employment? Employment “discrimination” means to treat a person differently, or less favorably because of your protected class(es).

If you have experienced a “negative employment” action because of a “Protected” class, you may file a complaint.  Keep in mind that “the burden of proof is on you to prove by the “preponderance of evidence” that the Employer’s action [not the person] was motivated by your perceived Race, chosen Religion, Sexual Orientation/Identity, Color, Age (40+), National Origin Sex (including pregnancy), and Disability status.  

Any employee that opposes a discriminatory practice, participates in the EEOC process by filing an internal/external complaint, encourages a person to file a complaint, or is listed as a witness in this process and experiences a “materially adverse employment action” may file a claim of “Retaliation.”     

Processing Time

Once you formally file an antidiscrimination charge with OAD, it will take approximately six (6) to nine (9) months to resolve. If you are unable to prove your claim of discrimination, you will be issued a Right to Sue Notice, which will permit you to file in court within 90 days.
