Requirements for Health Care Providers

As a health care provider in Delaware, you’ll play an important role in the new Delaware Paid Leave claims process. When a Delaware employee files for medical or family caregiver leave, their or their loved one’s health care provider will be required to complete a Certification of Serious Health Condition (CSHC) before the employer can adjudicate the claim.

You may already be used to completing certifications for the Family and Medical Leave Insurance Program (FMLA). The CSHC is similar, but it’s accessed and completed online.

As the employee’s health care provider, you will help the employer determine:

  • If the illness or injury meets the FMLA definition of a serious health condition.
  • How many weeks the employee should take off.
  • Which type of leave is appropriate (continuous, intermittent, or reduced).
  • For medical claims, your patient who is requesting time off will provide the CSHC.
  • For family caregiver claims, the loved one who is requesting time off to care for your patient will provide the CSHC.

  1. Employee files their claim, and Delaware LaborFirst checks for ineligible claims.
  2. Employee receives the CSHC access form and code.
  3. Employee provides the CSHC access form and code to you, as their or their loved one’s health care provider.
  4. You or your staff will use the code to access Delaware LaborFirst and complete the CSHC.

Health care providers will never be asked for private medical information protected by HIPAA.

You will not be required to provide a patient’s diagnosis or any other supporting medical materials (EKGs, X-rays, etc.).

In other words, you are entrusted by Delaware Paid Leave with the final decision on your patient’s eligibility.
