The Office of Labor Law Enforcement serves to ensure fair and equitable treatment in the workplace by enforcing or administering 21 state and federal labor laws, including wage payment, minimum wage, child labor, and prevailing wages for state-funded construction projects. The Office is made up of the two Units listed below.
It is the mission of the Wage and Hour Unit to provide public service through the fair, effective, and efficient administration of laws that protect the wages and fringe benefits of Delaware’s workers. This includes wage payment, minimum wage, child labor, meal breaks, the right to inspect personnel files, record keeping, special employment practices, and compliance with the requirement that certain entities post notices related to human trafficking.
Delaware’s Minimum Wage will be increasing on 1/1/2023.

The Construction Industry Enforcement Unit serves to educate employers and protect workers from unfair and/or unsafe working conditions through the enforcement of laws governing Delaware’s Prevailing Wage Law, Workplace Fraud Act (Worker Misclassification), Contractor Registration Act and all associated labor laws enforced by the Department.
